Terms & Conditions

Holiday QLD (“Holiday QLD”, “HQ”, “we”, “us”, “our”), provides peer-to-peer internet booking services to vendors. We are not a travel agent.

The terms and conditions below will apply to your purchase and booking of a Holiday QLD item. Please read the following terms and conditions carefully. You must be 18 years of age or older to make a booking. It is important you understand and agree with the following terms and conditions. You should not proceed with any purchase or booking unless you do.

We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking and that person will bind all such travellers to these terms and conditions. The person making the booking has ultimate authority over the booking, including amendments and cancellations.

Free Trial – Hosts

As a host, you may be offered a free trial by Holiday QLD. When you sign up for our free trial your trial expiry date will be visible in your booking manager login.

Our free trial offers zero commission and zero membership fees. Depending on the payment provider you select during setup you may incur additional charges by these payment providers upon acceptance of a booking and / or transfer to your nominated payment method. These fees are not charged by Holiday QLD. Please refer to PayPal or Stripe for further details on transaction fees.

Holiday QLD does not accept liability for charges you incur by using our selected online payment providers. All transaction fees are passed on to hosts by the payment provider.

Before your free trial expires you will be emailed the option to sign up for one of our premium memberships. If your free trial lapses, any items advertised by you will not be visible in search results. All other features remain functional and visible.

It is your responsibility to ensure your email address and contact details are updated within 3 days of any change. Please ensure our emails are not directed to spam.

AGENCY

We act as an internet booking service only. Our vendors offer a range of products and services (which may include but are not limited to flights, accommodation and car hire sometimes on behalf of others who provide those services. Our duties to you are limited to facilitating an internet booking on your behalf with those service providers. We are not responsible for providing those services to you, or for the standard of any service provided. If a service provider fails to provide you with a service, or you are not satisfied with the standard of any service provided, you agree that your only rights are directly against the service provider and not against us. You agree that we are not liable to you for any losses that you suffer in those circumstances, and that you will not claim against us (directly or indirectly) any refund, credit or other compensation. You agree that any money that you have paid to us will not be held on trust for you but will be used by us to make payment to the service providers to secure the booking for your travel services.

LIMITATION OF LIABILITY

We do not accept any liability, whether in contract, tort or otherwise, for any act or omission of travel service providers including their failure to provide a service whether through their negligence or otherwise. We do not make any representation about the standard of the services to be provided by travel service providers, and we accept no liability in that regard. We do not accept any liability, whether in contract, tort or otherwise, for any injury, losses, expenses, delays or inconvenience suffered by you in connection with your booking or your travel services, unless our liability is prescribed by legislation which cannot be excluded. Without limiting the foregoing, we will not be liable for any loss of benefit or change in status relating to any loyalty, rewards, frequent flyer or other program which result from the actions of a travel service provider, including a change in flights or a change in airline carrier. Where our liability cannot be excluded, our liability is limited to the amount that you have paid for your travel services.

RATES AND PRICES

Rates and prices quoted in print or on the website and quoted by our vendors are subject to availability and can be withdrawn or varied without notice. Price changes may occur at any time by reason of matters outside our control which increase the cost of the product or the service provided by the suppliers. Such factors include but are not limited to adverse currency fluctuations, fuel surcharges, price increases made by our suppliers, taxes and airfare increases.  Any price increase that is outside our control will be added to your account and is payable no later than 60 days from departure, at our absolute discretion and where suppliers permit we may also offer a refund. Rates and prices do not include any costs incurred en route to and from the destination, meals and/or alcoholic beverages (unless specified), telephone calls, items of a personal nature, and personal services not specified as being included in costs on the relevant web pages for each supplier’s product.

DEPOSITS, HELD BOOKINGS & FINAL PAYMENTS

You may be required to pay a deposit or deposits when booking. Our vendors will advise you of how much that will be. Payment of a deposit merely holds the reservation and does not guarantee that the final payment amount will not change due to circumstances beyond our control as referred to in “Rates and Prices”

All deposits are non-refundable (including where you or we cancel the booking for any reason) unless the booking is cancelled due to some negligence or breach of duty by us.

PAYMENT OPTIONS

Payments by B-Pay:

Please note that BPAY takes up to 3 business days to process.  If you are paying by this method, you will need to make the payment at least 3 business days prior to the actual due date.  You must notify your consultant of your payment once it has been made.

Payment by Credit Card:

Credit card surcharges apply and range between 0.17%- 0.81%, this surcharge will be advised on request and at time of charging. If you have paid any amount to us by credit card, you agree that you will not lodge any dispute with your credit card issuer about the validity of the transaction or the provision of goods or services by us, where a service provider fails to provide a service to you for any reason. You agree that your remedy lies against that service provider and not against us, and that by lodging a dispute with your credit card issuer you will be seeking a remedy against us in breach of these terms and conditions.

Payment by Cheque, Money Order or Cash:

Payment will not be accepted by Cheque, Money Order or Cash.

Holiday Queensland Gift Voucher / Coupon:

To make a booking using your gift voucher please enter the details at the time of checkout in the Coupon Code field. You must quote a valid gift voucher / coupon code to be able to redeem the voucher. Coupons cannot be entered by us and discounts cannot be applied after purchase.

Vouchers should be treated like cash, lost or stolen vouchers will not be replaced or refunded.

Vouchers are personal to the individual receiving them and can only be redeemed by that individual

Vouchers are not refundable after purchase, any amounts not used in 1 transaction will remain as a credit.

Vouchers are only to be used against the published packages found at www.holidayqld.com

Vouchers are valid for the period stated by us or your vendor. Expired vouchers are non-refundable in whole or part. Once expired, vouchers are no longer valid and will not be honoured.

Existing gift vouchers or credits cannot in any circumstances be used to purchase vouchers in full or as part-payment.

Your voucher may only be used to make purchases up to the initial voucher value. If you wish to make a purchase for an amount that exceeds the voucher value or the remaining voucher value, you must pay the excess using another payment method.

Where a trip paid using vouchers is cancelled, if any refund is due, will be refunded onto a new voucher.

Vouchers cannot be cancelled once they are issued except if voided by Holiday QLD or if their value is used or if they expire.

Vouchers may not, without the prior written consent of Holiday QLD be resold or offered for resale at a premium (including via online auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a voucher is sold or used in breach of this condition, Holiday QLD or the vendor may in its absolute and sole discretion cancel or render invalid the voucher without a refund and the voucher holder may be refused redemption of the voucher. Holiday QLD will take all reasonable steps to notify you of the intention to cancel or render invalid a voucher within a reasonable time before cancelling or rendering invalid the voucher.

Holiday QLD may cancel or render invalid any voucher (including any available balance) which Holiday QLD determines in its absolute and sole discretion was purchased at any time and in any way (including via online auction or other unauthorised resale sites) by fraudulent means. Holiday QLD may cancel any bookings made using any fraudulent voucher which may include any non-refundable amounts. Holiday QLD will not be responsible for any costs incurred by you if you purchase or attempt to redeem any fraudulent voucher. You acknowledge and agree that you will not be entitled to redeem any available balance on any fraudulent voucher and that Holiday QLD will not be obliged to hold such balance on file for you or otherwise redeem or exchange that voucher.

Personal information collected in relation to your voucher will be handled in accordance with Holiday QLD Privacy Policy which is available at holidayqld.com

The laws of Queensland, Australia apply to these terms and conditions and any disputes arising in relation to them.

Booking credit note:

Any booking may be converted to a booking credit note.  Booking credit notes may attract applicable supplier fees, but will not incur amendment or cancellation fees by us.  Each credit note will be valid for 12 months from the date your booking is placed into credit.  A booking credit note can be used for one or more future travel bookings, where the entire balance of a credit note is not used any balance will be held in accordance with these terms and conditions.  Once a new booking is made using a credit note, standard terms and conditions apply.  Booking credit notes are non-transferrable, non-refundable, and cannot be redeemed for cash or vouchers.

REFUND POLICY

Any bookings cancelled by the supplier or host due to the Australian (Federal or State) or New Zealand Government Outbound/Inbound International or Domestic Travel Restrictions or Quarantine Mandates relating to COVID-19, a fee free amendment, a full refund, or a full 100% credit note will be offered subject to the below Booking Credit Note terms and conditions. If flights are cancelled by the airline due to COVID-19, your booking will be subject to the applicable airline policy effective at the time of cancellation, which may only offer the option of a travel credit for the cancelled booking.

If your booking is not affected by the Australian (Federal or State) or New Zealand Government Outbound/Inbound International or Domestic Travel Restrictions or Quarantine Mandates relating to COVID-19 and you decide to cancel or modify your booking, our cancellation or amendment fees apply as per the below terms and conditions.

Refunds are at the discretion of each host or supplier and will be applied in accordance with their individual terms and conditions.

Holiday QLD reserves the right to intervene and adjudicate in any dispute between a host and a guest. Holiday QLD will undertake to investigate the matter thoroughly and impartially before adjudicating. All parties agree to be bound Holiday QLD’s adjudication to the extent permissible by QLD Law. All parties agree to indemnify Holiday QLD and its employees against any liability related to a dispute adjudication.

Amendment policy:

Booking amendments will incur a fee of $95, together with any additional fees applied by the service providers. Date changes are subject to availability, seasonality charges, and blackout dates.

CANCELLATION CHARGES

Guests will incur charges for cancelled bookings. Our service providers are entitled to impose cancellation charges, which can be up to 100% of the amount paid to them for the relevant service, regardless of whether travel has commenced. If any refunds are received from travel service providers, they will be passed on to you, less a minimum cancellation fee of $150.

Non-payment fees:

Should you default in making any payment in accordance with the agreed trading terms all monies owing to will immediately become due and payable. We will be entitled to charge interest at the rate of 3% above the 90 day bank bill rate as set by The Reserve Bank of Australia per calendar month on all overdue amounts from the date due for payment until the date of actual payment. We reserve the right to recover from you any expense and/or costs or disbursements incurred by us in recovering any outstanding monies including debt collection agency fees and legal costs.

Other Service Fees:

We reserve the right to apply other service fees in addition to those charged by airlines, resorts and other service providers, for any services provided by us in addition to those included in your booking. Some of these fees may include, but are not limited to, credit card surcharges, late booking fees, processing fees and urgent documentation delivery.

Payment Terms & Conditions

Payments are accepted from guests and secured at the time of booking. The payment will be held by our internet payment provider until the day after the booking is completed. Upon the host marking the booking as completed, payment will be transferred to the host.

Commission

Holiday QLD charges commission based on the total booking price and is relative to the chosen membership level. Commission is not added to the total booking price which provides guests with certainty that the advertised price is the price they will pay (no hidden fees or charges).

Our commission is calculated at the time of booking and is visible in your host dashboard along with your earnings. Commission is paid to Holiday QLD at the same time the host receives payment. At its sole discretion, Holiday QLD reserves the right to vary commission from time to time by providing hosts with 30 days written notice of its intentions.

Host Cancellation

Premium Membership is charged each month in advance.

Hosts have the option of cancelling membership at any time without penalty and any refund of membership fees will be at Holiday QLD’s sole discretion.

If the host chooses to cancel membership, it must honour any future confirmed and paid bookings within the following 30 days of membership cancellation. The host is responsible for initiating full refunds via our booking platform to any guest that has a confirmed and paid bookings beyond the 30 day period. The host is responsible for communicating with guests in relation to any and all matters related to cancelled bookings. The host agrees to indemnify Holiday QLD against any and all future liability related to booking cancellations for any anticipated or unforeseen circumstances.

In the event that the item is permanently unavailable for bookings and is sold, damaged or destroyed and booking cancellations are necessary, the host agrees to communicate with the guest and initiate a full refund in a timely manner via our booking platform.

If the item is temporarily unavailable the host agrees to communicate with the guest in a timely manner and offer a rescheduled booking, a gift voucher valid for at least 12 months or a full refund. Full refunds must not be unreasonably withheld. Holiday QLD reserves the right to intervene and adjudicate in any dispute between a host and a guest. Holiday QLD will undertake to investigate the matter thoroughly and impartially before adjudicating. All parties agree to be bound Holiday QLD’s adjudication to the extent permissible by QLD Law. All parties agree to indemnify Holiday QLD and its employees against any liability related to a dispute adjudication.

Hosts with flexible cancellation policies receive more bookings. Holiday QLD encourages hosts to provide a flexible and fair cancellation policy to guests but will not be held liable to any host or guest in the event of cancellation by either party.

Guest Cancellation

Guests may choose to cancel or reschedule their booking consistent with the hosts terms and conditions. In the event of cancellation for any reason you may be offered the opportunity to reschedule your booking, accept a gift voucher valid for at least 12 months or request a full refund.

Please contact the host via your account login and communicate directly with them. Holiday QLD will not intervene unless a dispute is raised. Holiday QLD reserves the right to intervene and adjudicate in any dispute between a host and a guest. If you choose to raise the dispute with Holiday QLD we will investigate the matter thoroughly and impartially before adjudicating. All parties agree to be bound Holiday QLD’s adjudication to the extent permissible by QLD Law. Guests agree to indemnify Holiday QLD and its employees against any liability related to a dispute adjudication.

Full refunds will only be provided by hosts if it is consistent with the hosts cancellation policy. We advise all hosts to provide a flexible and fair cancellation policy, Holiday QLD will not impose or replace a host policy.

After the declaration of COVID-19 as a global pandemic by the World Health Organization, the extenuating circumstances policy no longer applies because COVID-19 and its consequences are no longer unforeseen or unexpected. Please remember to review the host’s cancellation policy carefully when booking and consider choosing an option that provides flexibility.

TAXES

Australian departure tax is recorded on your ticket as being paid. All quoted taxes are subject to change until tickets are issued. There are still some countries where taxes are paid upon departure from the airport.

RESERVATIONS

Reservations (even after payment of your deposit and final payment) are subject to us receiving confirmation from the service provider including ticketing from the airline provider. In the rare instance where a reservation request cannot be confirmed by the service provider, you will be offered the choice of alternative arrangements (which may be with an alternative service provider), which may be at an additional cost or alternatively a full refund provided where the service provider allows. You agree that we are not liable to you for any such additional costs.

SPECIAL REQUIREMENTS

All seating and meal requirements must be requested at the time of booking. We do not provide any guarantees in relation to these requests, and they are subject to availability.

FLIGHT SCHEDULE CHANGES

The airlines have the right to reschedule or cancel flights at any time. It is your responsibility to contact the airline prior to travel to ensure the scheduled departure time has not changed. We do not accept responsibility should changes occur nor do we accept responsibility for any additional cost incurred by you to make alterations to your booking to accommodate these changes as these are beyond our control.

SUPPLIER CHANGES

Many of the bonus inclusions which are incorporated into various bookings have no associated costs to your package purchase price i.e. they are ‘free’ inclusions. This includes, but is not limited to, bonus inclusions such as cruises, golf, massages, day tours etc. Should you elect to cancel any component of your package there will be no refund forthcoming or any reduction in the overall package price. Additionally, should any ‘bonus’ inclusions be cancelled by an operator or any such service not be provided to you, no refund will be forthcoming nor will any additional service or compensation be provided unless offered directly to you by the service provider responsible for that service. In such circumstances that the inclusion cannot be provided for any reason, we may elect to find an alternate date, supplier or inclusion.

INSURANCE

It is the responsibility for all hosts and guests to have suitable and adequate insurance in place prior to accepting or making bookings. This includes but is not limited to a comprehensive policy, compulsory third party, travel insurance, public liability insurance and rental cover. Holiday QLD does not provide insurance advice or cover to hosts or their guests.

In the event of loss, damage or injury to any party, you agree to indemnify Holiday QLD and its employees, contractors or agents either in Tort or otherwise, to the extent permissible by QLD Law. Holiday QLD will not be held responsible for any loss, damage or injury as a result of or in connection with any booking product or service or the use of our service. You agree that Holiday QLD merely provides a way and means of connecting hosts with guests resulting in a private arrangement between the two parties. You agree that Holiday QLD is not a party to that arrangement or resulting contract but merely facilitated an introduction between the parties.

TRAVEL INSURANCE

We strongly recommend that you obtain travel insurance. The Australian Government also strongly recommends that all travellers obtain travel insurance prior to travel. You must obtain a Product Disclosure Statement relating to the travel insurance product you are considering purchasing and should read that documentation before making any decision about whether to acquire the product. If you do not obtain travel insurance, you acknowledge that you may be required to sign a disclaimer.

TRAVEL DOCUMENTATION

Travel Documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation, re-issue and/or amendment fees. All Travel Documents are non-transferable. All airline tickets must be issued in the name of the passport/photo identity holder and some carriers will deny carriage if the name varies from the passport or photo identification provided and the booking may be cancelled. It is your responsibility to ensure you have all required Travel Documents prior to travel. We will not be held responsible for tickets and/or documentation lost by you or a third party. Any charges associated with re-issue and re-sending of tickets and/or documentation will be at your expense. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility. Please advise us immediately of any errors.

PASSPORTS AND VISAS

It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Passports are required by all passengers travelling internationally and are always the responsibility of the passenger. Many countries require travellers to have at least six months’ validity remaining on their passports beyond the date of return, and immigration authorities may refuse entry if you arrive with less than this. Some countries require a machine readable passport.

If you are travelling to the United States (including Hawaii) please see https://esta.cbp.dhs.gov for information regarding compulsory pre-registration for their visa waiver program. Please note, you may not meet the requirements of ESTA and may be required to obtain a visa.

COVID-19

It is your responsibility to review the host’s cancellation policy carefully when booking and consider choosing an option that provides flexibility.

VACCINATIONS

Health requirements are the responsibility of all individual travellers. Our consultants are not qualified to advise you on vaccinations. Please contact your own doctor or a specialist vaccination clinic.

All users

All users of the Holiday QLD booking service agree to be bound by these terms and conditions. We reserve the right to vary these terms and conditions at any time. You will be notified by email 30 days prior to any changes.
